Wage Theft & Unpaid Wages
Wage theft is one of the most common — and most underreported — forms of worker exploitation in the Piedmont Triad. It happens when an employer fails to pay workers what they are legally owed: unpaid wages, stolen tips, illegal deductions from paychecks, off-the-clock work that goes uncompensated, or overtime that is never paid.
It is especially common in industries with large immigrant workforces: construction, agriculture, food service, landscaping, and manufacturing. Workers in these industries are frequently paid in cash, misclassified as independent contractors to avoid paying benefits and overtime, or simply shorted on hours — and many don’t come forward because they fear retaliation or don’t know their rights.

Your rights regardless of immigration status
Under the federal Fair Labor Standards Act (FLSA) and North Carolina’s Wage and Hour Act, all workers — regardless of immigration status — have the right to be paid for every hour worked at least at minimum wage, and to receive overtime pay when it is owed. Your employer cannot threaten to report you to immigration authorities to stop you from making a wage claim. That threat is itself illegal retaliation.
